These Terms of Service (“Terms”) govern your use of www.symphony42.com (the “Site”) and our public demonstration lines, operated by Symphony42 Corporation, a Delaware corporation (“Symphony42,” “we,” “us”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Business use
The Site is provided for businesses and their representatives to learn about Symphony42’s products and services. You must be at least 18 years old to use it. If you use the Site on behalf of a company, you represent that you are authorized to accept these Terms for that company.
2. Customer agreements control
Symphony42’s products and services are provided to customers under separate written agreements. Nothing on the Site is an offer, a quote, or a guarantee of pricing, availability, or performance; pricing and product descriptions on the Site are indicative and may change. If there is a conflict between these Terms and a written agreement between you and Symphony42, the written agreement controls for the services it covers.
3. Demonstration lines
Our demonstration agent (“Alex”) sells a fictional product for evaluation purposes only. No purchase occurs, no goods or services are delivered, and no payment information is requested or accepted; the demonstration checkout is a simulation. Calls and texts with demonstration agents may be recorded, transcribed, and reviewed. Use the demonstration lines only to evaluate our technology, and do not use them for any unlawful, abusive, or automated purpose.
4. Acceptable use
You agree not to: interfere with or disrupt the Site or the demonstration lines; attempt to gain unauthorized access to any system or data; scrape, crawl, or harvest content or data other than through ordinary browser use; reverse-engineer, probe, or test our agents for the purpose of building a competing product; misrepresent your identity or affiliation; or use the Site in violation of any law.
5. Intellectual property
The Site and its content — text, graphics, logos, images, audio, software, and the design and arrangement of the Site — are owned by Symphony42 or its licensors and protected by copyright, trademark, and other laws. Symphony42, the Symphony42 logo, Context Injection Service, Overture, Score, and Symphony42 OS are trademarks or service names of Symphony42 Corporation. You may view and print Site content for your own business evaluation; any other use requires our written permission. Symphony42’s AI voice selling system is the subject of a pending U.S. patent application.
6. Feedback
If you send us ideas, suggestions, or feedback about our products, you grant Symphony42 a perpetual, royalty-free right to use them without obligation to you.
7. Third-party links and content
The Site links to third-party sites and services, including LinkedIn, X, and YouTube, and republishes articles first published on LinkedIn. We do not control third-party sites and are not responsible for their content or practices.
8. Disclaimers
THE SITE AND THE DEMONSTRATION LINES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Information on the Site is for general informational purposes and is not legal, financial, or professional advice. Statements about performance, capabilities, or results describe our products generally and are not promises about results for any particular customer.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SYMPHONY42 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR THE DEMONSTRATION LINES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
10. Indemnification
You agree to indemnify and hold Symphony42 harmless from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Site or the demonstration lines.
11. Governing law and venue
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Maryland, and you consent to their jurisdiction.
12. Changes
We may revise these Terms at any time by posting the revised Terms on this page with a new effective date. Your continued use of the Site after a revision means you accept the revised Terms.
